Terms of Service

These Terms of Service (“Terms”) govern your use of BingeDeck’s website, app, community features, media-tracking tools, and related services (the “Service”). By creating an account, continuing as a guest, or otherwise using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use BingeDeck.
1. Eligibility and Your Account
- You must be at least 13 years old to use BingeDeck.
- Users who are at least 13 but under 18 may have mature or age-restricted media hidden or limited.
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for activity performed through your account except to the extent caused by BingeDeck’s own failure to protect the Service.
- You may not create accounts through bots, evade suspensions, impersonate another person, or use another person’s account without permission.
2. Acceptable Use
You may not use BingeDeck to:
- Post, send, or distribute unlawful, threatening, harassing, hateful, sexually exploitative, non-consensual intimate, or otherwise prohibited content.
- Post material that infringes copyright, trademark, privacy, publicity, or other rights.
- Share another person’s sensitive personal information without authorization.
- Spam, mass-message, manipulate community metrics, artificially inflate gamification, or abuse follows, comments, discussions, messages, lists, or reporting systems.
- Attempt to access another user’s private data, bypass authorization controls, probe for vulnerabilities without permission, distribute malware, or interfere with Service availability.
- Scrape, crawl, reverse engineer, or automate access in violation of these Terms, applicable law, or a third-party provider’s terms.
- Use BingeDeck or third-party provider data for fraud, surveillance, unlawful profiling, or other unlawful purposes.
3. Community Guidelines and Moderation
Our Community Guidelines are incorporated into these Terms. BingeDeck may use automated and human-assisted moderation, remove or limit content, restrict features, suspend accounts, preserve evidence, or take other reasonable action to protect users and the Service. Moderation systems are not perfect, and the presence of content does not mean BingeDeck endorses it.
4. Your Content
You retain ownership of original reviews, comments, list text, profile text, and other content you create. You are responsible for ensuring you have the rights needed to submit content, including images and GIFs.
By submitting content to BingeDeck, you grant BingeDeck a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, format, moderate, and process that content only as reasonably necessary to operate, secure, improve, and provide the Service, including displaying content according to your selected privacy settings and generating BingeDeck statistics or recommendations. This license ends when the content is deleted from BingeDeck’s active systems, subject to reasonable backup, legal, abuse-prevention, and dispute-retention needs.
5. BingeDeck Intellectual Property
BingeDeck’s software, original interface, branding, logos, product names, design elements, original documentation, and other BingeDeck-created materials are owned by BingeDeck or its licensors and are protected by applicable law. These Terms do not transfer ownership of BingeDeck intellectual property to you. You may not use BingeDeck branding in a way that falsely suggests sponsorship, endorsement, or affiliation.
6. Third-Party Media, Metadata, and Services
BingeDeck displays or links to media metadata, artwork, trailers, previews, availability information, maps, and other material supplied by third parties such as TMDB, YouTube/Google, Spotify, Apple/iTunes, Wikidata, OpenStreetMap, and their data partners. Those services and materials remain subject to their owners’ terms, licenses, trademarks, and rights. BingeDeck does not claim ownership of third-party media and does not host full movies or television shows.
Third-party services can change, restrict, discontinue, or revoke access at any time. BingeDeck may modify or remove affected functionality without liability when necessary to comply with provider requirements or maintain the Service.
7. YouTube API Services
BingeDeck uses YouTube API Services. By using BingeDeck features that access YouTube API Services, you also agree to be bound by the YouTube Terms of Service. Google’s handling of information is described in the Google Privacy Policy.
8. Spotify
Spotify integration is optional and is subject to Spotify’s applicable terms and policies. You must have any Spotify subscription or account status required for the feature you use. You can disconnect Spotify from BingeDeck in Settings. BingeDeck does not grant you any right to copy, download, redistribute, publicly perform, commercially exploit, or otherwise use Spotify Content outside the permissions supplied by Spotify.
9. Recommendations, Ratings, Availability, and Statistics
Recommendations, BingeScores, watch-provider availability, theater information, runtimes, ratings, release dates, community statistics, and other informational outputs may be incomplete, delayed, or inaccurate. They are provided for entertainment and informational purposes and are not guarantees. Third-party ratings and data should be identified as such.
10. Copyright and Repeat Infringers
BingeDeck respects intellectual-property rights. Our Copyright & DMCA page describes how to submit copyright notices and counter-notifications. BingeDeck maintains a policy of terminating, in appropriate circumstances, accounts of users who are determined to be repeat copyright infringers.
11. Safety Reports and Non-Consensual Intimate Images
Our Safety & Content Reports page provides a process for reporting abuse and requesting removal of qualifying non-consensual intimate images, including applicable computer-generated intimate images. BingeDeck may preserve report information and take action required by law, including the TAKE IT DOWN Act where applicable.
12. Privacy
Our Privacy Policy explains how BingeDeck processes information. Privacy and visibility controls are part of the Service, but you should not post information you do not want others to see when using public or social features.
13. Account Suspension and Termination
You may delete your account from Settings. BingeDeck may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, comply with law or provider requirements, respond to security issues, prevent abuse, or protect users. Serious violations may result in immediate action. Where appropriate, BingeDeck may retain limited records necessary to document enforcement, prevent repeat abuse, resolve disputes, or comply with law.
14. Service Changes and Availability
BingeDeck is evolving. Features may be added, changed, paused, or removed, and third-party integrations may become unavailable. We do not guarantee uninterrupted or error-free operation. We may perform maintenance or take emergency action when necessary.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, BingeDeck and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or opportunities arising from use of the Service. To the extent liability cannot be excluded, BingeDeck’s aggregate liability for a claim will not exceed the greater of the amount you paid BingeDeck for the Service during the twelve months before the event giving rise to the claim or US $100, except where applicable law requires a different result.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless BingeDeck and its operators from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Service, your content, or your material violation of these Terms. This section does not require you to indemnify BingeDeck for BingeDeck’s own unlawful conduct.
18. Feedback
If you voluntarily send ideas, suggestions, or product feedback, you allow BingeDeck to use that feedback without restriction or compensation, provided this does not transfer ownership of content that is otherwise yours.
19. Changes to These Terms
We may update these Terms. For material changes, BingeDeck may provide notice and require users to accept a new version before continuing. The last-updated date identifies the current published version.
20. General Terms
If part of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not assign your account or rights under these Terms without permission; BingeDeck may assign these Terms as part of a merger, acquisition, reorganization, or transfer of the Service. These Terms, the Privacy Policy, Community Guidelines, and incorporated policies are the agreement between you and BingeDeck regarding the Service, except for rights that cannot be limited by agreement.
