BingeDeck respects intellectual-property rights and expects users to do the same. This page explains BingeDeck’s copyright notice, counter-notification, and repeat-infringer process.
Third-Party Provider Content
BingeDeck displays metadata, artwork, trailers, previews, and other material supplied by third-party providers such as TMDB, Spotify, Apple/iTunes, and YouTube. BingeDeck does not claim ownership of that material and does not host full-length movies or television shows. If material is controlled and hosted solely by a third-party provider, a rights holder may also need to contact that provider directly.
User-Generated Content
Users may submit reviews, comments, discussions, profile material, list text, messages, images, or GIF attachments. If you believe material hosted or controlled by BingeDeck infringes your copyright, you may send a written notice under the Digital Millennium Copyright Act.
Submitting a Copyright Takedown Notice
A notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by one notice.
- Identification of the BingeDeck material claimed to be infringing and information reasonably sufficient for us to locate it, such as a URL, content ID, username, or attachment reference.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Send copyright notices to bingedeckapp@gmail.com with the subject DMCA Notice. You may also begin through the Contact page. BingeDeck will review notices in good faith and may remove or disable access to identified material while a claim is evaluated.
Designated DMCA Agent Registration
U.S. Copyright Office designated-agent registration is a separate external filing that cannot be completed through the BingeDeck application code. The operator must complete that filing and publish the registered agent’s legal name, mailing address, telephone number, and email address on this page. Until those details are added after the filing, BingeDeck does not represent on this page that a Copyright Office designated-agent registration has already been completed.
Counter-Notification
If BingeDeck removes or disables your content because of a copyright notice and you believe the removal was caused by mistake or misidentification, you may submit a written counter-notification containing:
- Your physical or electronic signature.
- Identification of the material removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original notice or that person’s agent.
Send counter-notifications to bingedeckapp@gmail.com with the subject DMCA Counter-Notification. When legally required, BingeDeck may forward a valid counter-notification to the original claimant and may restore material after the statutory waiting period unless the claimant provides notice of a court action seeking to restrain the alleged infringement.
Repeat Infringer Policy
BingeDeck maintains a policy of terminating, in appropriate circumstances, users who are determined to be repeat copyright infringers. BingeDeck may consider valid notices, counter-notifications, obvious abuse of the copyright process, account history, and other relevant circumstances when applying this policy.
Misrepresentations
Copyright notices and counter-notifications are legal documents. Knowingly materially misrepresenting that material is infringing or was removed by mistake may create liability under applicable law. If you are unsure whether a use is infringing, consider obtaining legal advice before submitting a formal DMCA notice.
